By accessing or using imperfeQt's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

imperfeQt provides AI-powered creative design and content services, including but not limited to generative art, e-commerce marketing, cover art design, video production, content creation, fashion design visualization, and architectural design assistance. Our services combine artificial intelligence technology with human creative expertise.

3. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information during registration.

4. Service Plans and Payment

On-Demand

Individual tasks purchased from our store. Payment is required before work begins.

Project-Based

Custom projects starting at $1,000 USD. A deposit of 50% is required upfront, with the remainder due upon project completion.

Subscription

Monthly subscription at $3,000 USD/month. Includes one active request at a time, unlimited total requests, and unlimited revisions. Billing occurs on a monthly basis. You may cancel at any time; cancellation takes effect at the end of the current billing period.

5. Intellectual Property

Your Content

You retain ownership of all content you provide to us (text, images, brand assets). By submitting content, you grant us a limited license to use it solely for providing our services.

Deliverables

Upon full payment, you receive full ownership and commercial usage rights to all final deliverables. Source files are included with subscription plans. We reserve the right to showcase completed work in our portfolio unless you request otherwise in writing.

Our Platform

The imperfeQt platform, including its design, code, AI models, branding, and proprietary technology, remains the exclusive property of imperfeQt.

6. AI-Generated Content

Our services utilize artificial intelligence to generate creative outputs. You acknowledge that:

• AI-generated content may occasionally produce unexpected or imperfect results
• All outputs are reviewed and refined by our human team before delivery
• We cannot guarantee that AI outputs will be entirely unique across all contexts, though we take reasonable measures to ensure originality
• You are responsible for ensuring that delivered content complies with applicable laws in your jurisdiction

7. Revisions

Subscription plans include unlimited revisions. For project-based work, the number of revision rounds is defined in the project scope. On-demand services include revisions as specified in the service description. Revisions must relate to the original brief; significant scope changes may require a new project.

8. Acceptable Use

You agree not to use our services to:

• Create content that is illegal, harmful, threatening, abusive, or violates any third-party rights
• Generate deepfakes or deceptive content intended to mislead
• Reproduce copyrighted material without authorization
• Attempt to reverse-engineer our AI systems or technology
• Resell or redistribute our services without authorization

9. Limitation of Liability

To the maximum extent permitted by law, imperfeQt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold imperfeQt harmless from any claims, damages, losses, or expenses arising from your use of our services, your violation of these terms, or your infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to our services at any time for violation of these terms. Subscription cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

12. Changes to Terms

We may modify these terms at any time. We will notify you of significant changes via email or through our platform. Continued use of our services after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which imperfeQt operates, without regard to conflict of law provisions.
