1. Introduction

DAVINCI HORIZON - FZCO ("imperfeQt," "we," "our," or "us") operates the imperfeQt platform at imperfeqt.ai and related services (the "Services"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Services.

By using the Services, you consent to the practices described in this Policy. If you do not agree, please do not use the Services.

2. Information We Collect

Information You Provide

• Account information: name, email address, and profile details when you create an account. If you sign in with Google or Vercel, that service shares your name, email address and profile picture with us, and nothing else from your account there
• User content: prompts, conversations, uploaded files (images, PDFs, documents), and generated content
• Payment information: billing details processed securely through Stripe. Every account gets a Stripe customer record (your name and email) when it is created, so a seat or a top-up can be bought later
• Communications: feedback, support requests, and other information you send us

Information Collected Automatically

• Device information: browser type, operating system, and device identifiers
• Log data: IP address, access times, pages viewed, and referring URLs
• Usage data: features used, models selected, and the cost of each call
• Cookies: session and preference cookies to maintain your login and enhance your experience

3. How We Use Your Information

We use collected information to:

• Provide, operate, and maintain the Services
• Process transactions, manage your account, and charge usage to your wallet
• Improve, personalize, and develop new features
• Communicate with you about updates, security alerts, and support
• Monitor and analyze usage patterns to enhance the platform
• Detect, prevent, and address technical issues, fraud, and abuse
• Comply with legal obligations

4. AI Processing and Training

Your prompts, conversations, and uploaded files are sent through Vercel's AI Gateway to the provider of the model you choose, to process your requests and deliver responses. A few features use a fixed provider, also through the gateway: the opening message of each conversation goes to OpenAI to name the conversation; when a model searches the web, the search queries it writes go to Perplexity; dictation (your recorded audio) and read-aloud (the text of the reply) go to OpenAI. This is necessary to provide the Services.

The Qrew's agents, which come with Qraft, run on the model you pick (Anthropic's Claude unless you pick another), make pictures with Recraft and short clips with Google's Veo unless you choose other picture and clip models in Settings (a clip's model is sent its description and, if you ask for it, one of your pictures as a link that expires within an hour), all through the gateway; the searches they write go to Exa, and the pages they read are fetched from those pages' own sites. The Qrew also remembers short facts you tell it (your work, your audience, your voice, your preferences), shared by its five agents, until you or an agent removes one or you delete your account, and keeps what you write for it in Settings (about you, and instructions for each agent) until you change it or delete your account.

We do not use your data to train AI models. Your content is used solely to provide you with the Services. Third-party AI providers may have their own data policies, which we encourage you to review (see Section 6).

5. Data Sharing and Disclosure

We do not sell your personal information. We may share your data with the following categories of third parties:

• AI providers — through Vercel's AI Gateway, to process your prompts and generate responses (see Section 6)
• Infrastructure providers — hosting, database, storage, and deployment services
• Payment processors — to securely handle billing and transactions
• Legal authorities — when required by law, subpoena, or to protect our rights
• Corporate transactions — in connection with a merger, acquisition, or sale of assets

6. Third-Party Service Providers

We use the following third-party services to operate the platform. Each has its own privacy policy. Model calls go through Vercel's AI Gateway to the provider of the model you choose, or to the fixed provider of a feature (section 4); the main providers are listed below, and the product names the provider of every model it offers.

• Anthropic (Claude) — AI chat models. Privacy Policy
• OpenAI (GPT) — AI chat and image models, conversation titles, dictation and read-aloud. Privacy Policy
• Google (Gemini, Veo) — AI chat, image, and video models, and sign-in with Google. Privacy Policy
• xAI (Grok) — AI chat, image, and video models. Privacy Policy
• Perplexity — Web search, when a model searches the web. Privacy Policy
• Exa — Web search, when an agent of the Qrew searches the web. Privacy Policy
• Recraft — Image models, and the pictures the Qrew makes. Privacy Policy
• Neon — Database, through the Vercel Marketplace. Privacy Policy
• Stripe — Payment processing, and a customer record (name and email) for every account. Privacy Policy
• Vercel — Hosting, the AI Gateway that routes model calls, private file storage, analytics, bot protection (BotID), and Sign in with Vercel. Privacy Policy
• Google Analytics — Website traffic analysis on our public pages. Privacy Policy
• Resend — Transactional email delivery. Privacy Policy

AI providers may change as we add or remove models. We will update this list accordingly.

7. Data Security

We implement industry-standard security measures to protect your information, including:

• Encryption in transit (TLS) for all data transmission
• Passwordless sign-in (emailed codes, passkeys, or your Google or Vercel account): no passwords stored
• Sessions kept on our servers and expiring automatically
• Your files stored privately and shown only to you; when you send a file to a model, its provider receives a copy of it or a link to it that expires within an hour
• Your own AI Gateway key, if you connect one, stored encrypted and never shown again

No method of transmission over the Internet is 100% secure. We cannot guarantee absolute security, but we use reasonable efforts to protect your data.

8. Data Retention

We retain your data for as long as your account is active or as needed to provide the Services. Conversation history is stored to enable your chat history feature. Upon account deletion, we will delete your data within 30 days unless required by law to retain it. You may request deletion of your data at any time.

9. Cookies

We use cookies and similar technologies to maintain your login session, remember your preferences, and analyze site usage. We use session cookies (which expire when you close your browser) and persistent cookies (which remain until deleted). You can control cookie preferences through your browser settings, but disabling essential cookies may affect functionality. For detailed information, see our Cookie Policy.

10. GDPR Rights (EEA Users)

If you are located in the European Economic Area, you have the following rights under GDPR:

• Right of Access — request a copy of your personal data
• Right to Rectification — correct inaccurate or incomplete data
• Right to Erasure — request deletion of your data
• Right to Restrict Processing — limit how we use your data
• Right to Data Portability — receive your data in a portable format
• Right to Object — object to processing based on legitimate interests
• Right to Withdraw Consent — withdraw consent at any time where processing is based on consent

11. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the right to:

• Know what personal data we collect and how it is used

12. International Data Transfers

Your data may be transferred to and processed in countries outside your country of residence, including the United States. We ensure appropriate safeguards are in place for such transfers in compliance with applicable data protection laws.

13. Data Breach Notification

In the event of a data breach that poses a risk to your rights and freedoms, we will notify affected users within 72 hours as required by GDPR and notify the relevant supervisory authority. We will also comply with any additional breach notification requirements under applicable laws.

14. Do Not Track

We do not currently respond to Do Not Track (DNT) browser signals. For more information about DNT, visit allaboutdnt.com.

15. Children's Privacy

The Services are not intended for individuals under the age of 16. We do not knowingly collect personal information from children. If you believe we have collected data from a child under 16, please contact us immediately so we can take appropriate action.

16. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Services after changes constitutes acceptance of the updated Policy.
